1.1. These Terms of Service and Privacy Policy (“Terms”) govern your access to and use of Lucid, a platform for chatting with virtual AI characters and generating AI-powered images (the “Service”), operated by MPR Labs Inc. (hereinafter referred to as “Lucid,” “we,” “us,” or “our”).
1.2. Lucid operates as a Telegram bot. By using our Service, you also agree to comply with Telegram’s Terms of Service and Privacy Policy.
1.3. You acknowledge that your use of Lucid is subject to Telegram’s policies regarding web apps, and you agree to adhere to these policies in addition to our Terms.
1.4. By accessing or using the Service, you engage with our service and accept these Terms, including any additional rules and provisions as well as policies specified herein and/or accessible by means of a link. If you disagree with any part of the Terms, you may not access the Service.
1.5. These Terms apply to all users of the Service, including, without limitation, users that are browser clients and content co-authors.
1.6. Any new features or tools added to the current Service shall also be subject to these Terms. You can review the latest version of these Terms at any time on this page. We reserve the right to update, amend or change any part of these Terms by publishing the updates and/or changes on our website. It is your duty to check periodically whether any changes have been made. After the publication of changes, your continued use of the Service means your acceptance of the changes.
2. Eligibility and Access
2.1. You must be of legal age in your country of residence to use the Service. In most cases, this means you must be at least 21 years old. By using the Service, you represent and warrant that you meet this age requirement.
2.2. We reserve the right to refuse access to the Service to anyone for any reason at any time.
2.3. You are responsible for maintaining the confidentiality of your account. You agree to accept responsibility for all activities that occur under your account.
2.4. You may not use our products for any unlawful or unauthorized purpose, and your use of the Service cannot violate any laws in your jurisdiction (including, but not limited to copyright laws).
2.5. Breach of any provision hereof by you will result in the termination of your use of the Service.
3. User Content and Conduct
3.1. The Service allows users to interact with AI characters and generate AI-powered images. You understand and agree that you are solely responsible for any content you create, request, or generate through the Service.
3.2. You agree not to use the Service to:
a) Create, request, or distribute any illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable content.
b) Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity.
c) Violate any applicable laws or regulations.
d) Infringe upon or violate our intellectual property rights or the intellectual property rights of others.
3.3. You agree to refrain from reproducing, copying, selling, reselling or using any part of the Service, or any contact provided on our website where the Service is provided without our express written consent.
4. Zero-Tolerance Policy for Illegal Content
4.1. Lucid maintains a strict zero-tolerance policy regarding any illegally-generated content or illegal use of our Service. This includes, but is not limited to:
a) Unauthorized person impersonation
b) Child exploitation or child pornography
c) Non-consensual intimate imagery
d) Content that promotes or facilitates human trafficking or prostitution
e) Explicit violence or gore
f) Any other content that violates local, national, or international laws
4.2. Any violation of this policy will result in immediate account suspension without prior notice.
4.3. Lucid reserves the right to report any illegal activities or content to relevant law enforcement authorities without prior notice to the user.
4.4. Users are required to immediately report any illegal content they encounter on the Service through our Telegram support account.
4.5. Lucid will fully cooperate with law enforcement investigations related to illegal content or activities on our Service.
5. Intellectual Property Rights
5.1. The Service and its original content (excluding user-generated content), features, and functionality are and will remain the exclusive property of Lucid and its licensors. All rights, titles and/or interests (either registered or unregistered) recognized in any country of the world or jurisdiction in the Service and any material published therein are reserved.
5.2. You retain any copyright you may have in the content you create using the Service. However, by using the Service, you grant Lucid a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your content in any existing or future media.
5.3. You acknowledge that the AI-generated content may be based on or similar to existing copyrighted works. Lucid does not claim ownership of such underlying works and cannot guarantee that the use of AI-generated content will not infringe upon third-party rights.
5.4. Our status as the author of the material on the Service should always be stated if you refer to the contents of our Service in your activities.
6. Privacy and Data Collection
6.1. By using Lucid, you agree that we may collect and use certain data as described in this section. We are committed to protecting your privacy and handling your data in an open and transparent manner.
6.2. We collect the following information:
a) Your Telegram public profile information, including your username and profile name.
b) Telegram bot and web app usage data, including content of conversations with our AI.
6.3. Use of collected data:
a) We use your Telegram public profile information to provide and improve our Service.
b) We may use conversations between users and our AI to improve the quality of our service. We do not publish conversational data or share it with any third parties, except as required for the technical provision of the Service through Telegram.
c) Telemetry data is used for technical service provision and improvement of our Service.
6.4. Data sharing:
a) We do not sell, rent, or lease your personal data to third parties.
b) We may share your data with Telegram as necessary for the provision of our Service.
c) We may disclose your information if required by law or in response to valid requests by public authorities (e.g., a court or government agency).
6.5. You understand that the contents of any information you provide may be transmitted unencrypted and may involve transmissions over a variety of networks and modifications to conform or adapt to the technical requirements of connection to communication networks or their devices.
7. Disclaimer of Warranties
7.1. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. Lucid makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties of merchantability, fitness for a particular purpose, non-infringement of intellectual property, or other violation of rights.
7.2. Lucid does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the Service or any content generated through the Service.
7.3. We do not make any guarantees or assurances and make no claims regarding the validity, accuracy, correctness, suitability or accessibility of the Service or any material published on the Service. If there are links to third-party websites on our Service, the same provisions apply to these websites and any material published on them. You are responsible for any use of the same. Such use cannot serve as a basis for our liability.
8. Limitation of Liability
8.1. In no event shall Lucid, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
a) Your access to or use of or inability to access or use the Service;
b) Any conduct or content of any third party on the Service;
c) Any content obtained from the Service; and
d) Unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.
8.2. To the extent practically permitted by law, we expressly waive liability for any direct, indirect losses or damage, including, but not limited to the loss of profits, decline in sales, loss or termination of operations, loss of data or information, loss of goodwill and/or reputation arising out of or in connection with your use of or the inability to use the Service and the consequences of such use.
9. Changes to Service and Pricing
9.1. We reserve the right to change our prices at any time with no prior notice.
9.2. We reserve the right to modify or terminate the Service (or any part thereof or content) with no prior notice.
9.3. We are not liable before you or any third party for any modifications to the Service, price changes, service suspension or termination.
10. Payment and Refunds
10.1. Your request to refund payments made for the use of our product may be satisfied if a valid claim for a refund is made within 24 hours from the moment of subscription purchase.
11. Changes to Terms
11.1. We reserve the right to modify or replace these Terms at any time.
11.2. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised Terms.
12. Governing Law and Jurisdiction
12.1. These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
12.2. The exclusive jurisdiction for these Terms shall be United States courts, but we reserve the right to launch court proceedings against you for breach of these Terms in the country of your residence.
12.3. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
